Supreme Court Restores David Mark as ADC Chairman, Faults INEC Over Derecognition

Nigeria’s apex court, the Supreme Court of Nigeria, has nullified the decision that led to the derecognition of former Senate President, David Mark, as National Chairman of the African Democratic Congress (ADC).

In a unanimous ruling delivered on Thursday, the court set aside an earlier order issued by the Court of Appeal, describing it as “unwarranted, unnecessary, and made in bad faith.”

Why the Supreme Court Overturned the Decision

Justice Mohammed Lawal Garba, who read the lead judgment, held that the appellate court acted outside its jurisdiction by issuing a preservative order that was not requested by any of the parties involved in the case.

The controversial order had enforced a status quo ante bellum, which subsequently prompted the Independent National Electoral Commission (INEC) to withdraw recognition from David Mark and the ADC’s National Executive Committee.

The Supreme Court ruled that such an order lacked legal basis, thereby invalidating all actions taken as a result of it.

Immediate Implications for ADC and 2027 Politics

With the judgment now in force, INEC is expected to formally restore David Mark and his executive team as the legitimate leadership of the ADC.

This ruling is significant ahead of Nigeria’s evolving political realignments toward the 2027 general elections.

The ADC, which has been positioning itself as a coalition platform for opposition figures, may now regain internal stability and strategic direction.
